Being arrested in a police prostitution sting is embarrassing, stressful, and confusing. Most people immediately wonder whether they’re going to jail, whether this can stay off their record, and whether the police already have enough evidence to convict them. From the officers’ perspective, the investigation is often complete once they believe an agreement has been reached.

The buyer then travels to the meeting location, which is often a hotel room. After arriving and identifying themselves, or after knocking on the door, law enforcement makes the arrest.

Many people are surprised to learn that the arrest usually occurs before any money changes hands or any sexual activity takes place.

One Mistake I See Over and Over Again

One mistake I see over and over again is people believing that no crime has occurred until money actually changes hands.

Unfortunately, that is not how these cases are usually prosecuted.

In many prostitution sting operations, officers believe the offense is complete once there has been an agreement to exchange money for sexual services and the buyer arrives at the agreed-upon location. As a result, many arrests occur before a single dollar is ever exchanged.

That surprises many first-time offenders who assumed they could simply change their mind at the last second. While backing out may still be important depending on the facts, many investigations are considered complete long before payment is ever made.

They would end up arresting them for solicitation if they show up. This allows the police to catch men who want to buy patronizing prostitution  and women who are  providing. However, not all these cases are slam dunks for the prosecution. A prostitution charge has elements to it and in a criminal court the case has to be proven by a reasonable doubt.

What Evidence Do Police Usually Have?

By the time the case reaches the prosecutor, law enforcement has usually gathered several different pieces of evidence.

This commonly includes the original advertisement, the text messages exchanged during the investigation, your phone number connecting you to those messages, body camera footage, the money found on you at the time of your arrest, any statements you made after being detained, and the police report prepared by the investigating officers.

The strength of the case often depends on how all of this evidence fits together, which is why I spend so much time reviewing every piece of it before advising a client

Why Your Phone Is Often One of the Strongest Pieces of Evidence

Another thing all Police Prostitution Stings have in common is the text message exchange. Almost all purchasers exchange phone messages (which discusses lingo and terms) with the police and have the cell phone on them when they are arrested at the door.

Unfortunately having a cellphone when caught in one of the many Police Prostitution Stings makes it harder for your criminal defense lawyer to defend the accusations of prostitution you are facing.  One of the most common solicitation defenses or defense defense strategy is the either mere presence or just hanging out. In simpler terms nothing has been said yet.

One of the biggest misconceptions about prostitution sting cases is the type of person who gets arrested. Over the years, I’ve represented engineers, nurses, business owners, military members, students, and parents. There is no “typical” client.

Police target men more than women in the name of human traffic. The penalties are more severe for men and even worse for pimps. The rationale from the prosecution is that sex workers should be treated as victims of crime, not criminals.

Over the years, I’ve represented clients from virtually every profession and background imaginable. Engineers, nurses, military personnel, business owners, students, and retirees have all found themselves caught in these investigations. There is no “typical” client.

Married men are concerned that their wife will find out. College students come into police stations crying because their parents are going to kill them. Am I Going to Jail?

One of the first questions people ask is whether they are going to jail.
For most first-time offenders, the answer is usually no.
While solicitation carries a maximum penalty of up to six months in county jail and a fine, those maximum penalties are generally reserved for more serious or repeat offenders. In my experience, first-time prostitution cases are far more likely to result in alternatives that focus on resolving the case without jail.
That does not mean you should take the charge lightly. Even without jail, a criminal conviction can still have significant consequences if it is not handled properly.

One Thing I’ve Learned Defending These Cases

One thing I’ve learned over the years is that the people arrested in prostitution sting operations are often not who most people imagine.
Many are professionals, business owners, parents, military members, licensed professionals, or people with no prior criminal history whatsoever. They are often embarrassed, scared, and worried about what this arrest could mean for their careers and families.
Because of that, I never assume the police report tells the whole story. Instead, I focus on reviewing the actual evidence, including the text messages, body camera footage, and police reports, to determine whether the prosecution can actually prove the case.

What Happens After You’re Arrested?

After the arrest, you will usually receive a citation containing your personal information, your court date, and the courthouse where you are expected to appear.
Depending on the circumstances, you may also receive booking paperwork before being released.
In many Orange County cases, the District Attorney’s Office will later mail additional paperwork or notices to your home address. That is something many people overlook, especially if they are trying to keep the arrest private from a spouse, partner, or other family members.
Because of that, it is important to stay on top of your mail and respond to any court notices promptly.

Should I Talk to the Police?

Generally speaking, no.
You should not try to explain what happened, guess at answers, or admit to prior conduct. Anything you say can later be included in the police report and used against you in court.
At the same time, you should remain polite and respectful. There is no benefit to arguing with the officers or becoming confrontational. Staying calm, providing identification if required, and exercising your right to remain silent is usually the best course of action until you have spoken with an attorney.

Can Police Pretend to Be Escorts?

Yes.
Police officers are legally allowed to pose as escorts during undercover investigations. They may create online advertisements, communicate through text messages, and arrange meetings as part of a sting operation designed to identify people willing to pay for sexual services.
The fact that an officer pretended to be an escort does not automatically make the arrest illegal or amount to entrapment.

What If No Money Changed Hands?

Many people assume they cannot be charged if they never actually handed over any money.
Unfortunately, that is not always true.
In many prostitution sting operations, officers make the arrest before any payment is exchanged. If they believe there was already an agreement to exchange money for sexual services and you traveled to the meeting location, prosecutors may argue that they have enough evidence to file criminal charges.

Can Deleted Text Messages Be Used?

Yes.
Deleting text messages from your own phone does not necessarily make them disappear.
Officers still have the messages on their undercover phone, and those conversations are often preserved as evidence. They can also use your phone number and other evidence to connect you to the text messages, even if the messages no longer appear on your device.

Will This Affect My Professional License?

It depends on your profession.
Different licensing boards have different rules and reporting requirements. Nurses, teachers, attorneys, government employees, law enforcement officers, members of the military, and members of the clergy may all face different consequences depending on their profession and the outcome of the criminal case.
Because many of my clients hold professional licenses, one of my goals is to resolve the case in a way that minimizes those long-term consequences whenever possible.

Will This Affect My Immigration Status?

If you are not a United States citizen, you should consult with an experienced immigration attorney as soon as possible.
Certain criminal offenses can have immigration consequences depending on the facts of the case and your immigration status. Because immigration law is highly specialized, it is important to receive advice from an attorney who regularly handles immigration matters before making decisions about your criminal case.

What If I Was Just Curious?

People are naturally curious, and simply being curious is not a crime. In many situations, someone may respond to an advertisement, exchange a few text messages, or even ask questions without ever intending to follow through.
The important distinction is what happens next.
If the conversation never develops into an actual agreement and you never travel to the meeting location, it is unlikely that anything will come from it.
On the other hand, if there is an agreement to exchange money for sexual services, you travel to the hotel, and you arrive at the agreed-upon location, it becomes much more difficult to argue that you were merely curious. At that point, prosecutors will often rely on the text messages and your actions to argue that you intended to follow through.

Can I Change My Mind?

Yes. People change their minds all the time.
If you decide not to go through with it and simply never show up, it is unlikely that anything will happen. Law enforcement generally is not interested in pursuing people who never arrive at the meeting location.
However, changing your mind becomes a much more difficult argument if you have already reached an agreement, traveled to the hotel, and knocked on the door. By that point, officers often believe the offense has already been completed and may make the arrest before any money is exchanged.
Whether a “change of mind” argument will help depends on exactly when you decided not to follow through and what the evidence shows.
