VC 23152 and 23153 Reworded

VC 23152 and 23153 Reworded

The California Vehicle Code is seeing another amendment in 2014, in the form of VC 23152 and 23153. These two sections of the code are being recast and reworded. The VC 23152 and 23153 Reworded  in subsection (a) now states that “It is unlawful for a person who is under the influence of any alcoholic beverage to drive a vehicle”. Also, the wording in subsection (b) now states that “It is unlawful for a person who has a 0.08 percent or more, by body weight, of alcohol in his or her blood to drive a vehicle”. Subsections (c) and (d) also have been affected.

It is crucial that one always keeps VC 23152 and 23153 Reworded in mind when planning on drinking and driving. Not only will you get into legal trouble, but it can be potentially harmful to yourself, your passengers, and anyone else on the road at that time. Car accidents, especially those that occur while someone is under the influence of alcohol or drugs, can be disastrous and even fatal.

Elements That Must Be Proven

It is necessary for the prosecutor to prove specific elements in order for you to be charged with VC 23152 and 23153 Reworded. One is that you were driving a vehicle, and the other is that you had a BAC of 0.08% at the time that you were driving. There are strict ways in which this can be proven with the right evidence, but it is still on the prosecutor to successfully present these pieces of evidence in order to have you convicted of the crime. There are some defenses that may be used for these scenarios, such as the fact that your breathalyzer sample was tainted, that your BAC was not actually 0.08% at the time that you were driving, that your blood test was not properly stored or collected, and others.
