Our client got a Successful Shoplifting Charge Dismissal, a head of household and an engineer of South Asian descent, was responsible for providing for his family. On a visit to the Costco at Tustin Marketplace, he purchased approximately $250 worth of items. Unnoticed, he left some toner at the bottom of his cart and walked out of Costco. He was subsequently stopped and accused of shoplifting. Distressed, he approached us for help. When questioned about the incident, he admitted to shoplifting but couldn’t explain his actions.

In order to get this Successful Shoplifting Charge Dismissal, we arranged for him to receive counseling from Nancy Clark, the developer of the diversion program used at the Orange County Courthouse. Through her services, he addressed his underlying issues. We presented this progress to the court and used it in negotiations with the Orange Coutny DA’s office. This approach resulted in a favorable outcome for our client, ultimately leading to the dismissal of the charges.

What specific legal strategies did your firm employ to negotiate with the DA’s office for this shoplifting case?

The specific strategy our firm employed in this case, when negotiating with the DA’s office, was to emphasize rehabilitation. We got our client to enroll in individual counseling well ahead of the initial court arraignment date so we can set it up for pretrial negotiations. We needed to show that he acknowledged his problems and was taking care of them. In other words, it was better to let our client continue with his therapy and also be given a chance, rather than be taken down the punitive route, which would have led to probation and a criminal record.

How did the counseling with Nancy Clark impact the case’s outcome, and is this a common approach in similar cases?

No, this approach is not common in many of our cases. In this particular situation, our client had the means to purchase the items he took. He did not steal out of necessity, nor to save money. Our client acted on an impulse without understanding why. This case is unique because, had we just taken care of the case and gotten it dismissed, the underlying conditions might have led our client back to us with new charges. We needed to get our client help to ensure he does not return as a repeat customer. At our office, we believe in not just addressing the legal case, but also in identifying and preventing any root causes from reoccurring to increase the Successful Shoplifting Charge Dismissal

What were the underlying issues that your client faced, and how were they relevant to the shoplifting incident?

The underlying issues our client faced regarding his shoplifting were more related to stress. Cultures, especially those of South Asian and Asian descent, often place a lot of stress on their children. When raised, these children internalize this stress and, when they go to the store, they try to find their voice. Psychologists often refer to this as an irresistible impulse that they can’t control. For these types of cases, our office takes a special approach to maximize the Successful Shoplifting Charge Dismissal that has worked with first-time, second, and third-time offenders.

Can you explain more about the diversion program developed by Nancy Clark and its effectiveness in court cases?

Nancy Clark pioneered the diversion program used by the Orange County courts since the 1980s or 1990s. Her name carries a lot of weight at the Orange County Courthouse.

How does your firm approach cases involving first-time offenders or individuals with no prior criminal record?

In order to increase the chance of a Successful Shoplifting Charge Dismissal our firm approaches cases involving first-time offenders or individuals with no criminal record by prioritizing the prevention of any convictions. We understand that a clean record allows a person to affirm they have never been convicted of a crime. This is crucial for securing jobs and opportunities in the future. Hand down the best attorney I have ever worked with!!! My friend recommended Hieu because I needed to expunge something I did when I was young and dumb. Hieu is very humble, personable, and made me feel very comfortable. He's surprisingly funny too. Something not all lawyers are / can do. His pricing is very reasonable and he updated me on everything frequently. I highly recommend him!!!!

I had interviewed many attorneys to discuss my very unfortunate situation that was set by someone I knew. Hieu Vu was the most honest, caring, and professional attorney with compassion and empathy I ever interviewed. HE REALLY HAD A HEART. His fees were very reasonable and he will fight for you not just for your dollars but because he cares for his clients... I would strongly recommend him if you feel your life is upside down. Things happen but we learn to become better person.
