Disneyland Public Intoxication Case Dismissed: International Client Success

Our client, visiting the United States from Australia, enjoyed his time in downtown Disneyland and got picked up for Disneyland Public Intoxication. However, he eventually passed out in front of the AMC theater, lying in his own vomit. The Anaheim Police Department responded, took him into custody, and issued him a citation. Being on vacation, he chose not to attend court and returned to Australia, believing there would be no significant repercussions for a 647F California misdemeanor.

However, complications arose with his Disneyland Public Intoxication when a United States arrest warrant was issued against him, leading to travel restrictions. He faced difficulties re-entering the United States to clear his warrant, as he risked immediate arrest by Customs upon arrival. Seeking resolution, he contacted our office. We represented him in court, clearing the warrant while he remained abroad. Had he appeared in court and pled guilty, he would have faced a year of probation and a conviction on his record.

The only way to clear an Orange County Bench Warrant is to have the case called and the warrant quashed. A client does not need to be physically present in the country. He can hire an attorney who deals with bench warrants at the local courthouse to quash the warrant. However, after quashing the warrant, the bench warrant attorney still has to address the case.

For an attorney familiar with the local courthouse and its proceedings, this should not be a problem. The most challenging part is accommodating the client in different time zones.

Each case is different. Not every case is dismissible, and the facts of each case vary. Additionally, the skill of the attorney and their reputation at the courthouse play a role.
